REGISTRATION AND ACCESS TO RESERVED SERVICES

 To become a registered user of the ARTAUCTIONPILOT web site, the user must fill in all the mandatory fields on the registration form. The user must declare that he is over 18 years old and legally entitled to enter into this contract.

The user agrees to provide accurate, complete and up-to-date data, particularly their personal details, and to make the necessary corrections to that end where necessary.

Once registered, the user has a user name and password that are strictly personal and confidential.

ARTAUCTIONPILOT specifically applies the French Informatique et Libertés law no. 78-17 of 6 January 1978, amended by the law 2004-801 of 6 August 2004, incorporating into French law the Directive 95/46/EC of 24 October 1995 on privacy and data processing in the European Union and law no. 2004-575 of 21 June 2004 on "trust in the digital economy" (article L. 33-4-1 amended of the Post and Telecommunications Code and new L. 121-20-5 of the Consumer Code), Directive 2000/31/EC of 8 June 2000 on e-commerce and Directive 2002/58/EC of 12 July 2002 on privacy and data processing in electronic communications

The user has the right to consult and correct his personal data.

The user may exercise this right directly at any time on the

 ARTAUCTIONPILOT website by correcting, supplementing or deleting personal data.

LIABILITIES

The user expressly acknowledges that web-related constraints make it impossible for ARTAUCTIONPILOT to guarantee the permanent security and availability of data transmissions on the website.

ARTAUCTIONPILOT may not be held liable for any dysfunction or denial of access to the website attributable to the user’s internet service provider, bandwidth saturation, hardware incompatibility or any other circumstance beyond the control of ARTAUCTIONPILOT.

Similarly, ARTAUCTIONPILOT may not be held liable for any dysfunction or denial of access to the Artcurial.com website due to a maintenance operation or upgrade of the said website.

In case of disclosure or usurpation of a user’s identity to/by a third party, the user shall be liable for any actions taken by means of his personal user account, whether fraudulent or not.

Should any claim be filed against

 

ARTAUCTIONPILOT following a user’s infringement of the law or these General Conditions of Use, the latter agrees to insure ARTAUCTIONPILOT for the legal consequences thereof.

Any request required by the user will be transmitted by ARTAUCTIONPILOT to the Auction Houses at the same time. ARTAUCTIONPILOT will do its best to answer to the needs of the user as soon as possible but is not responsible for a wrong information, a missing information or a late information.

while seeking to minimise these errors, nevertheless accepts no responsibility for the presence of any erroneous information on its data bank. By this contract the user renounces any claim or right to engage in litigation relative to any loss or injury caused by any such errors on the basis of contractual or criminal responsibility or on any other basis.

INTELLECTUAL PROPERTY – COPYING

 ARTAUCTIONPILOT website is dedicated to presenting activities of the auction houses.

In this context, various illustrations, reproductions and quotations of original works may be displayed on the Artcurial.com website. These are lawfully featured on the Artcurial.com website under the terms of the short quotation exception provided for in article L122-5 of the Intellectual Property French Code.

Any copying, in full or in part, of the catalogue presented by ARTAUCTIONPILOT on the website is strictly forbidden and represents an infringement for which offenders may be prosecuted under the provisions of Book III of the Intellectual Property French Code.

 ARTAUCTIONPILOT cannot guarantee the complete accuracy of any information supplied on the works presented on the website.

The user account is strictly for the user’s personal use.

Consequently, the user undertakes not to sell, transfer or license his right to access the reserved services on the website to another party.

The user undertakes by subscribing to this service not to reproduce, store or change the reproductions of works viewed using whatever medium and to whatever end.
